In fact, many transgender persons are not capable of making their own healthcare decisions in these situations. Our white paper that explores this topic found that it's critical for transgender individuals to carefully review their emergency and end-of-life legal documents. Transgender individuals should consider working with trusted attorneys and advisors to create customized emergency and end-of-life legal documents, such as healthcare powers of attorney, advance directives, or living wills.

These documents should be prepared for a worst-case scenario in which healthcare professionals may ignore or dismiss the patient's gender identity, which can in turn impact the quality of healthcare they receive. If possible, these documents should be prepared by attorneys who have experience helping members of the LGBTQ+ community combat these complex legal issues. The agents named in these documents – trusted friends, partners, supportive family members – should be empowered to direct healthcare providers to fulfill the patient's wishes.
